RESERVATION AND PAYMENT ARRANGEMENTS
Reservation takes effect with the submission of an online registration. The surf camp participants then receive a confirmation of reservation and tips on how to prepare for the trip. The company reserves the right to confirm a reservation up to 24 hours after receiving the online registration. Once a booking is made it can be changed by the customer within 24 hours, afterwards the booking will be proceeded and the full amount needs to be paid.
To secure the booking, full payment is required to be made by bank transfer or other payment methods available as stated in the reservation confirmation. Arising bank transfer fees or currency exchange fees needs to be paid by the participant.
The company reserve the right to cancel a reservation after a written reminder by e-mail, if the down payment is not paid in time.
Transfers from/to the airport can only be organized on your behalf and guaranteed once the flight details (flight number, flight arrival time, airline) are sent to our reservations team at least 72 hours before arrival. Unless the customer books a private room for single use (extra single use surcharge) the room needs to be shared with other travelers. These can be either male or females. There are no “female/male only”rooms. Add ons that were booked before arrival can only be cancelled free of charge once the company didn’t have any costs for booking them already. Custom shaped boards cannot be cancelled after the booking.
All surf packages include surf guiding. Surf guiding takes place in the morning and in the afternoon. Every customer has the option to join a session subject to availability twice a day. The limit per session is 6 participants.
Surf guiding includes the area introduction by one of our surf guides and guiding while being in the water. Theory lessons and video analysis will be offered and are included in the price. Any surf equipment such as surfboards, wax, leashes and sunscreen are not included in the package but can be purchased or rented upon arrival.
Due to certain public holidays, team events or strong weather conditions, the surf guiding might not be possible. The surf camp will organize an alternative subject to possibilities and according to weather and Sri Lankan law.
PREREQUISITE FOR PARTICIPATION
The participant explicitly declares that there are no medical reservations as far as his/her active surfing is concerned. Participants must be at least 18 years old.
LIABILITY
The company is not liable for damages as a result of personal injuries.
The company’s liability for damages that are not personal injuries are limited to the triple journey price. Liability for the loss of or damage to participants’ property (like for example surf boards) on the part of the organiser shall be excluded. We recommend a private baggage/surf board insurance and health insurance for the respective period. The organiser’s equipment and vehicles should be treated in due form. The participant shall be liable for damages in the case of negligent or wilful damage or loss. In the case of damage to the vehicles by a third party in the Indonesian traffic, costs will be carried jointly by everyone in the car involved.
1. Coverage of injury:
The participant acknowledges that Kima Surf is not responsible for any injuries, damages, losses, or delays that may occur both during organized Kima activities and within the camp premises. The participant agrees to participate in all activities at their own risk and holds Kima Surf harmless from any liability arising from personal injury, including death, whether caused by negligence or otherwise, during the entire duration of the trip.
2. Exclusion of third-party actions:
The participant acknowledges that Kima Surf shall not be held liable for any actions or omissions of third parties, including third-party service providers, that may result in loss, damage, cost, expense, or delay. This includes but is not limited to accommodations, transportation, and any other services arranged by third parties.
3. Failure to comply with obligations:
The participant acknowledges that they are responsible for complying with all obligations, rules, and instructions provided by Kima Surf. Kima Surf shall not be liable for any loss, damage, cost, expense, or delay suffered or incurred due to the participant’s failure to comply with any of their obligations, including but not limited to safety guidelines, activity instructions, or any other requirements communicated by Kima Surf.
4. Failure to possess required travel documentation:
The participant acknowledges that it is their sole responsibility to possess, obtain, and maintain all necessary travel documentation required for the trip, including but not limited to valid passports, visas, health certificates, and any other documents as required by the relevant authorities. Kima Surf shall not be responsible for any loss, damage, cost, expense, or delay suffered or incurred due to the participant’s failure to possess, obtain, or maintain the required travel documentation.
5. Failure to follow instructions:
The participant acknowledges that it is their responsibility to follow all reasonable instructions provided by Kima Surf, including but not limited to specified check-in and check-out times, meeting places, and any other instructions related to the activities or the trip. Kima Surf shall not be liable for any loss, damage, cost, expense, or delay suffered or incurred due to the participant’s failure to follow reasonable instructions provided by Kima Surf.
CANCELLATION/TRAVEL EXPENSE RETURN
Guests may cancel their Kima Surf booking at any time before the date of their stay, cancellation fees vary on the amount of notice given. A booking is not officially canceled until a written notice is received by Kima Surf Head Offices. The date Kima Surf received the written cancellation is when the cancellation policy is effective. In the case that a guest does have to cancel their booking, the following fees are applied according to the length of notice given.
With a cancellation made 28 days or more before the date of arrival you will have to pay a non-refundable charge that is 10% of the price of the room package price.
With a cancellation made 14 to 27 days before the date of arrival you will have to pay a non-refundable charge that is 30% of the price of the room package booking.
With a cancellation made 7 to 13 days before the date of arrival you will have to pay a non-refundable charge that is 60% of the price of the room package booking.
With a cancellation made 2 to 6 days before the date of arrival you will have to pay a non-refundable charge that is 90% of the price of the room package booking.
The room package price is non-refundable if the guest gives a 1-day notice or won’t show up at the camp at all.
A replacement participant can be provided. In this case, as in the case of any reservation changes, an administration charge of 50€ has to be paid. As far as boat trips are concerned, if weather conditions are unacceptable we are unfortunately forced to cancel the trip up to 2 days before. Any payments made will be reimbursed.
COVID-19 Term’s and Condition’s changes:
Due to the ongoing global pandemic of COVID-19 we have made the following changes to the Terms and Conditions list above effective 01/09/2020 until further notice.
1) Any changes to a booking will no longer carry an administration fee of 50 EUR. Any and all changes will be free of charge.
2) Guest can request a full refund should they have to cancel their stay due to travel restrictions enforced by COVID-19 (Please note – Any transfer fees will be borne by the cancelling guest)
3) Due to seasonal price changes any postponed booking may need to be re-calculated
4) Should you wish to move your postponed booking to a different camp a recalculation of price will be performed
5) Any postponed stay can be taken at any given time or date, there will be no expiry or time limit
6) Any postponed stays will be like for like. The same booking will apply unless a request is made to reduce the cost of the stay due to seasonal or camp surcharges
7) Should a postponed stay result in a lower cost, the amount will be used towards any additional add-ons or payments whilst at the camp or used as a discount towards a future stay
DATA PRIVACY STATEMENT
This website uses Google Analytics, a web analysis service of Google Inc. (“Google”). Google Analytics uses “Cookies”, which are text files stored on your computer to analyse your use of the website. The information generated by the cookie on your use of the website will be transferred to a server of Google in the USA and saved there. On behalf of the website operator, Google will use this information to assess your use of the website, draw up reports on your website activities and to provide further services connected with the website and Internet use vis-à-vis the website operator.
PROTECTION OF PERSONAL DATA
To protect your personal data the IP anonymization for Google Analytics has been activated. Within the European Union or in other states party to the Agreement on the European Economic Area, Google abbreviates the activated IP anonymization of your IP address before it is transferred to a server. Only in exceptional cases will the complete IP address be transferred to a server in the USA and abbreviated there. The IP address transmitted by your browser within the scope of Google Analytics will not be used in connection with other data by Google. Should we have further personal data of our website users, we will not use these for website tracking data purposes or link these with other non-personal data.
DEACTIVATION OF WEBSITE TRACKING BY WEBSITE USERS
You can prevent cookies being stored by setting your browser software accordingly. However, here we would point out that in such a case you cannot use all the functions of this – and other – website(s). You can nevertheless prevent the transmission of the data generated by the cookie to Google and reference to the website (incl. your IP address), and also the processing of these data by Google, by downloading and installing the browser plugin: http://tools.google.com/dlpage/gaoptout?hl=en.
USE OF THE ADVERTISING FUNCTION OF GOOGLE ANALYTICS
On this website, alongside the standard configuration of Google Analytics, Google Analytics functions are also used to support interest-related advertising based on the users’ surf behaviour. Here Google Analytics uses a third-party cookie by DoubleClick, to evaluate the data on the users’ surf behaviour on various websites. Using these data, statistical statements can be made on demographical data and fields of interest of website users. We expressly draw your attention to the fact that we are not able to see any information about the individual users, and the statistical data which we use cannot be traced back to specific users. After visiting our website, some of our website visitors will receive placements of our advertisements on other websites. This form of ad placement is known as re-marketing or re-targeting. If you would like to object to this ad placement, we would recommend you use one of the above mentioned possibilities of deactivating the website tracking by a website user.
